1. About these Terms

These Terms form an agreement between the person or organization using ArtDoon (“you”) and the legal operator identified above (“ArtDoon,” “we,” or “us”). They apply to the ArtDoon website, Studio, artwork library, exhibition editor, public profiles, visitor pages, and related services.

By creating an account or using an authenticated feature, you accept these Terms and acknowledge the Privacy Policy. If you use ArtDoon for an organization, you confirm that you may accept these Terms for that organization.

2. Eligibility

You must be at least 18 years old and legally able to enter a contract. ArtDoon is intended for artists, studios, galleries, curators, and other professional or independent creative users. Do not create an account for another person without authority.

3. Accounts and security

Provide accurate account information, keep your password confidential, and promptly tell us if you suspect unauthorized access. You are responsible for activity performed through your account unless applicable law provides otherwise.

Email verification is required before publishing. We may require renewed verification after a material account change. One person or organization may not use multiple accounts to evade limits, suspension, or enforcement.

4. The service

ArtDoon lets you upload and manage artwork, select an architectural Space, arrange an Exhibition, add text or supported media, create a public artist profile, and publish a visitor link. Features vary by Space, plan, device, browser capability, and development stage.

Drafts are private to the account or anonymous browser identity that owns them. Published Exhibitions and public Profiles are intentionally available to anyone who can access their URL. Unpublishing removes normal public access but cannot recall copies, screenshots, caches, or links already shared by visitors.

5. Founding beta, plans, and payment

ArtDoon is currently a pre-launch beta. Features may be incomplete, changed, paused, or removed as the service is prepared for launch. Beta access may be free, invite-only, or subject to limits shown in the Studio.

Some features are marked as paid or restricted even where billing is not yet active. We will not charge you unless we clearly show the price, billing period, taxes where applicable, renewal terms, and an explicit purchase action. Before activating paid consumer services, ArtDoon will provide legally required pre-contract and withdrawal information.

Storage, artwork-count, Space, media, and publishing limits displayed in the product are part of the applicable plan. We may adjust beta limits with reasonable notice when the change materially affects saved work.

6. Your content and ownership

You keep ownership of artwork, text, video, audio, profile material, and other content you submit (“Your Content”). These Terms do not transfer copyright ownership to ArtDoon.

You grant ArtDoon a worldwide, non-exclusive, royalty-free license to host, copy, encode, resize, format, transmit, display, and otherwise process Your Content only as needed to operate, secure, improve, and promote the ArtDoon service and your chosen public Exhibitions. This license lasts while the content is stored, plus a reasonable period for deletion from backups and caches. Promotion outside your public ArtDoon pages requires separate permission unless it is a direct link or preview generated from a public Exhibition.

ArtDoon converts uploaded artwork into a web-optimized derivative for the viewer. Keep your original and archival files; ArtDoon is not an archival storage service.

7. Your content responsibilities

You confirm that you own Your Content or have all permissions needed to upload, process, publish, and license it as described here. This includes copyright, trademarks, publicity and privacy rights, music and performance rights, model releases, and permissions for people or private information depicted in the content.

Do not upload or publish content that is unlawful; infringes intellectual property or privacy; is fraudulent, defamatory, threatening, or harassing; exploits minors; promotes terrorism or criminal activity; contains malicious code; or is otherwise incompatible with these Terms.

Artistic nudity, difficult subjects, or political expression are not prohibited merely because they may be controversial. Context, legality, visitor safety, and the rights of others will guide moderation.

8. Acceptable use

You must not:

  • probe, bypass, or interfere with authentication, quotas, access controls, or security;
  • scrape, crawl, or automate access in a way that burdens the service or violates law;
  • upload malware, deceptive files, or content intended to exploit a browser or visitor;
  • impersonate another person or misrepresent affiliation, authorship, or provenance;
  • use ArtDoon to spam, phish, collect credentials, or send unsolicited marketing;
  • resell access, reverse engineer protected parts, or copy ArtDoon Spaces except where law permits;
  • use visitor or contact information obtained through ArtDoon for unrelated surveillance or profiling.

9. Public content, moderation, and reports

We may review reports and restrict, unpublish, remove, or preserve content where reasonably necessary to enforce these Terms, comply with law, protect rights or safety, investigate abuse, or maintain the service. We aim to act objectively and proportionately and may consider context, severity, recurrence, and available evidence.

To report illegal, infringing, or Terms-violating content, use the Contact page. Include the exact URL, the material concerned, the legal or policy basis, your contact details, and a statement that the report is accurate. Knowingly false or abusive notices may result in restrictions.

When appropriate and legally permitted, we will tell the affected account what action was taken and why, and how to ask for review. Contact mail@artdoon.com to contest a moderation decision.

10. Copyright complaints

A copyright notice should identify the protected work, identify the allegedly infringing ArtDoon material and its URL, explain your authority, provide contact information, and include a good-faith statement that the use is not authorized. We may forward the notice to the account holder and may restore content if a credible counter-notice or authorization is provided.

11. Print listings and off-platform transactions

ArtDoon may let eligible artists display descriptive prices and a contact address. ArtDoon is not the seller, buyer, payment processor, marketplace, shipping provider, authenticator, or party to any resulting transaction. Artists and visitors are responsible for identity checks, contracts, payment, taxes, delivery, returns, authenticity, and disputes.

12. ArtDoon materials

The ArtDoon software, interface, brand, logos, documentation, and supplied 3D Spaces are protected by intellectual-property laws. Except for the limited right to use the service under these Terms, no rights are granted in those materials. Feedback may be used without restriction or payment, but we do not claim ownership of artwork submitted with the feedback.

13. Third-party services and links

Exhibitions may use or link to third-party services, such as YouTube, an artist website, Instagram, email clients, hosting infrastructure, or content-delivery services. Their terms and privacy practices apply separately. ArtDoon does not control third-party availability, content, or transactions.

14. Availability, backups, and changes

We work to keep ArtDoon available but do not promise uninterrupted or error-free access. Maintenance, security events, provider failures, browser changes, and beta development may cause interruption. Keep local copies of original artwork, text, and important exhibition records.

We may change the service to improve performance, security, usability, or legal compliance. We will provide reasonable notice before a change that materially removes a paid feature or prevents normal export of stored content, unless urgent security or legal action requires faster change.

15. Suspension and termination

You may stop using ArtDoon or permanently delete your account through Profile settings. We may restrict or terminate access for serious or repeated violations, security risk, non-payment of an active paid plan, or legal necessity. Where appropriate, we will give notice and an opportunity to export content or appeal.

Provisions concerning ownership, licenses needed for residual backups, liability, disputes, and accrued obligations survive termination where their nature requires it.

16. Disclaimers

To the extent permitted by law, ArtDoon is provided “as is” and “as available.” We do not guarantee artistic, commercial, sales, visitor, compatibility, search-ranking, or preservation outcomes. Nothing in these Terms excludes warranties or remedies that cannot legally be excluded, especially mandatory consumer rights.

17. Liability

ArtDoon remains liable where liability cannot be limited, including for intent, gross negligence, personal injury, fraudulent concealment, and mandatory product or consumer liability. Subject to those rules, ArtDoon is not liable for indirect or consequential loss, lost profits, lost opportunities, or loss caused by content or services outside our control.

For users acting in business, aggregate contractual liability for ordinary negligence is limited to the amount paid during the 12 months preceding the event, or EUR 100 if no amount was paid, except where a higher minimum is required by law. This limitation does not apply to consumers where it would be invalid.

18. Responsibility for claims

If you use ArtDoon for business, you will reimburse reasonable losses and costs resulting from a third-party claim that Your Content or deliberate misuse violates law or another person’s rights, to the extent you are responsible under applicable law. We will notify you and allow reasonable participation in the defense. This does not reduce consumer rights.

19. Governing law and disputes

The governing law and competent courts must be completed with the operator details before launch. Any choice of law will not remove mandatory protections available to consumers in their country of residence. Before filing a claim, please contact us so the matter can be addressed directly.

The former EU Online Dispute Resolution platform was discontinued in July 2025, so these Terms do not direct consumers to that retired service.

20. Changes to these Terms

We may update these Terms for new features, legal requirements, security, or operational changes. The page shows the current version and date. Material changes will be communicated through the service or by email before they take effect where required. Continued use after the effective date constitutes acceptance only where legally valid; otherwise we will request renewed consent.

21. Contact

Questions, notices, appeals, and legal communications may be sent through the Contact page or to mail@artdoon.com.
